Terms of Use for Hosting a Region (Simulator)
1. Restrictions and prohibitions
- Clubs / Shops: Allowed, limited to one (1) per owner across all simulators rented from our company.
- Child avatars: Strictly prohibited.
- Farms: Prohibited.
- Pets: Allowed with reasonable usage (maximum 20 per simulator).
2. Simulator management
- Simulators may be classified as adult regions.
- Upgrades are allowed; downgrades are not allowed (no downgrade).
- Any unauthorized or prohibited activity may result in a warning and/or immediate closure of the simulator without refund.
3. Payment and account status
- Late payments are tolerated for up to seven (7) days.
- After seven (7) days: the simulator may be taken offline (access to backups remains available).
- After one (1) month of non-payment: all data may be permanently deleted.
4. Backup and restore policy
- Four (4) automatic backups per day are performed in NO-ASSETS mode.
- Automatic backups are provided as a safety and convenience service.
- Restore points are available for a maximum period of two (2) rolling days (date to date).
- One (1) backup per day including assets is allowed for export purposes only.
- In case of user error, restores must be performed using NO-ASSETS OAR files. Assets are managed by the OSgrid infrastructure and services.
5. Service availability – obligation of means
- We are bound by an obligation of means, not an obligation of result.
- Interruptions may occur (maintenance, updates, incidents, external dependencies).
- No guarantee is provided regarding the absence of interruption or error.
6. Payment, refunds and non-refund policy
- Any rental period that has started is non-refundable.
- One month paid = one non-refundable month, regardless of usage.
- No refund is granted, including in the event of:
- Change of mind by the customer
- Early termination requested by the customer
- Violation of provider rules
- Sanctions, suspensions or bans issued by OSgrid
- Due to repeated abuse of refund requests in the past, refunds are not granted under normal conditions.
7. Exceptional service failure
- If we are unable to provide the service for more than four (4) consecutive days, a partial refund may be considered.
- Any compensation is strictly limited to the unused time corresponding to the unavailability.
- No full refund will be granted.
8. Limitation of liability
- No liability for indirect damages, data loss, business loss, or loss of virtual assets.
- No liability for incidents originating from OSgrid, third-party services, or external infrastructures.
- Use of the service is at the customer's own risk.
9. Suspension and termination
- We reserve the right to suspend or terminate the service without notice in case of abuse, violation of these terms, or illegal activity.
- No refund is granted in case of termination due to a violation of the rules.
10. Force majeure
- No liability in the event of circumstances beyond our reasonable control (power/network outages, disasters, government actions, etc.).
11. Personal data (GDPR)
- Only data strictly necessary for the operation of the service is collected.
- No personal data is sold.
- Users may request access, correction, or deletion of their data.
12. Changes to these terms
- We may update these terms at any time.
- Continued use of the service constitutes acceptance of the updated terms.
13. Applicable law and jurisdiction
- These terms are governed by French law.
- Disputes fall under the jurisdiction of the courts of the company's registered office.
By purchasing or using the service, you acknowledge that you have read, understood and accepted these terms,
including the non-refund policy.
